Maple Leaf Class Action Update – March 10, 2009
The Ontario certification and settlement approval hearing was heard before Justice Perell of the Ontario Superior Court of Justice on Thursday, March 5, 2009. Justice Perell released his decision on March 9, 2009, certifying the class action and approving the Settlement Agreement reached between the parties on December 18, 2009 [Attach here]. The Ontario approval covers persons resident in Ontario, British Columbia and Alberta who purchased or consumed recalled products manufactured, processed or packaged by Maple Leaf between January 1, 2009 and August 20, 2009.
Concurring approval orders must be obtained in courts in Québec and Saskatchewan in order for the settlement to be effective, as follows: March 20th, 2009 in the Québec Superior Court for Québec residents; and March 10th, 2009 in the Saskatchewan Court of Queen’s Bench for residents of all other provinces and territories.
