ODSP Data Breach

ODSP Data Breach

IMPORTANT UPDATE – May 5, 2025

In a decision released on January 8, 2025, the Superior Court of Ontario did not certify the proposed class action against the Ministry of Children, Community, and Social Services in relation to the disclosure of a spreadsheet containing the name, ODSP identification numbers, and email addresses of ODSP recipients. The proposed class action is set to be discontinued, at which point, the limitation period will resume running. Any individuals interested in pursuing a claim individually in relation to the events described in the statement of claim should contact a lawyer.

The text of the decision can be found here: Quantz v. Ontario, 2025 ONSC 90.

Here is the Statement of Claim.

Disability recipients whose information was breached are set to sue the province

On January 23rd, 2019, Rochon Genova served the Ministry of Children, Community and Social Services with a Notice of Action, announcing our intention to initiate a class proceeding on behalf of the 45,000 ODSP recipients whose names, email addresses, and ODSP identification numbers were disclosed without authorization in December 2018.

If you were affected by this unauthorized disclosure, please note that you do not need to take any action to be a part of the proposed class proceeding. Class proceedings in Ontario automatically bind class members, unless they explicitly and deliberately ‘opt-out’ to proceed individually.

However, we greatly appreciate the opportunity to speak directly to potential class members, and encourage you to contact us. Please email Jon Sloan at [email protected] or, telephone 416-363-1867, ext. 299.
