Update – May 25, 2023

The Canadian OxyContin Class Action Settlement will be open for claim submission shortly. The Settlement will compensate eligible class members for various injuries that they suffered due to addictions they developed from using the prescription drugs Oxycontin and/or OxyNEO.

Anyone who was prescribed and ingested OxyContin and/or OxyNEO in Canada between January 1, 1996, and February 28, 2017, may be eligible to receive compensation from the settlement. Estates of deceased Canadian Oxy users are also eligible to file claims, as are spouses, children, and certain other family members.

ALL CLAIMS MUST BE SUBMITTED BY FEBRUARY 27, 2024. It can take time to collect the necessary supporting documentation required by the terms of the Settlement, so do not delay in starting this process.

Update – October 3, 2022

On September 23, 2022, the Honourable Chief Justice Popescul of the Saskatchewan Court of King’s Bench released his written decision approving the OxyContin® and OxyNEO® National Settlement Agreement as being fair, reasonable and in the best interest of Class Members. We are pleased that we are now one step closer to providing some compensation for the significant harms that have been caused by opioid addiction in connection with Oxy’s prescription and use.

The settlement provides for a total settlement payment of $20 million (CDN), $2 million of which is designated for provincial health insurers. A total of $18 million plus interest, minus court approved legal fees and disbursements, the costs of notice and claims administration, and applicable taxes, will be distributed to eligible class members.

After dismissal orders are all issued and become final, a Notice will be distributed and published in the media providing information about settlement approval. The claims process will thereafter begin, during which a Class Member and/or Family Class Member must file a claim with the court-appointed Claims Administrator by a deadline that is nine (9) months after the date the Notice is distributed.

Compensation won’t be distributed to approved Class Members and Family Class Members until sometime after the nine-month claims deadline has passed. We will communicate additional information about the Settlement and claims process as it becomes available.
