I Have Been Injured In A Car Or Motorcycle Accident, What Should I Do?
First, seek medical attention. It’s important that you get a proper diagnosis of your injuries and receive medical treatment promptly. Even if you feel fine, it is important to get checked by your doctor so that there is a medical record of what happened. Your treating doctor may identify a health issue or impairment that you may not have noticed in the wake of your accident.
Second, report your accident. Make sure there is a police report or some record of the incident that includes details like what happened, when it happened, who witnessed it. Take and keep photographs of the accident scene, damages to the vehicle(s), damages to personal property and visible injuries. Ensure that you collect the contact information of any witnesses and other people involved.
Third, provide notice of your accident to your insurance company. There may be time limits involved, so make sure you provide notice as soon as possible.
As soon as you are able, you contact us to discuss your case.
How Long Do I Have To Bring A Legal Action Against The At-fault Party Involved In The Accident?
As a general rule you have two years from the date of an incident to bring legal action. This time period may be extended depending on the facts of your case. In cases that involve negligence on the part of a city or municipality there may be short deadlines as short as 10 days from the date of the accident. It is always best to contact a lawyer as soon as possible after a personal injury to ensure that you protect your legal rights.
Also, if you have been in a car accident, you should inform your accident benefits insurer of accident within 7 days of it happening and complete the accident benefits application within 30 days of the accident.
What Can I Sue For?
Each case has unique facts and different outcomes. However, you may be able to recover compensation for pain and suffering; loss of past and future income; lost education; housekeeping and home maintenance expenses; future medical expenses; rehabilitation expenses; and for “special damages” which can include out-of-pocket expenses incurred as a result of the accident.
How Much Money Will I Recover In A Settlement?
It is impossible to know what your claim is worth without considering a wide variety of factors including the extent of the injury, the final prognosis, the economic consequences of the harm caused and/or legal restrictions on recovery. Our personal injury team will meet with you to discuss all aspects of your case to help ensure you receive the best possible outcome.
How Long Will It Take To Resolve The Case?
The litigation process in Ontario can be lengthy. Many personal injury cases in Ontario take 1-3 years resolve. If your case goes to court, it may take longer. The amount of time the Claim takes depends on factors such as: the age of the injured person; how soon they recover from their injuries; when we receive information about what the future holds for the injured person and court schedules.
