Sunquest Class Action – February 20, 2009

On February 18 and 19, 2009, ROCHON | GENOVA LLP appeared before the Divisional Court where our appeal was heard from the decision which denied certification in this case. Our appeal was heard by Justices Hackland, Swinton and Karakatsanis and a decision has been reserved. We will be updating this website upon receiving the decision of our appeal.

On June 23 and 24, the certification hearing was held in Toronto. Unfortunately, the Ontario Superior Court did not certify this case as a class proceeding.

On November 14, 2005, our law firm launched a class action against MyTravel Canada Holidays Inc. and MyTravel Group plc on behalf of all persons who reserved a trip through Sunquest and vacationed at the Riu Resorts in Dominican Republic between November 1, 2004 and June 7, 2005.

The class proceeding was commenced by Suzanne Lavier on behalf of herself and the class members. The claim seeks damages for the class resulting from the outbreak of a viral illness at the Riu Resorts during the class period. The allegations have not yet been proved in court.
