Oxycontin Class Action Update – October 21, 2010

On June 8, 2007, the law firms of ROCHON | GENOVA LLP and Siskinds LLP issued a class action in Ontario on behalf of persons in Canada, other than in Québec, who were prescribed and who ingested Oxycontin® against the manufacturers of Oxycontin®, Purdue Pharma, Purdue Pharma Inc., Purdue Frederick Inc., The Purdue Frederick Company, Inc. and Purdue Pharma LP (the “Defendants”). The claim, filed with the Ontario Superior Court of Justice, alleges that the Defendants knew or ought to have known that ingesting Oxycontin® leads to drug dependency and addiction yet the Defendants failed to take any or adequate steps to warn of such dangers in the product monograph. Oxycontin® is a narcotic frequently prescribed as a pain-killer.

On July 7, 2010, the Nova Scotia Court of Appeal upheld the decision of a motion judge in striking the claims of four ex juris plaintiffs named in the Nova Scotia action. Click here to see a copy of this decision.

As for the Ontario national class, we are also now addressing jurisdictional matters and finalizing certification materials. We expect there to be many further developments in the coming months.
