Oakridge Group Action Update – November 3, 2010

Pursuant to the reasons of Mr. Justice Cullity dated March 30, 2006, the court granted leave for the plaintiffs to continue with a multi-plaintiff group action following the failed class action certification. We commenced a multi-plaintiff group action on behalf of some thirty-seven individuals on October 12, 2006.

Since then, we have proceeded to the discovery stage of the litigation. We have coordinated and completed the scanning of the plaintiffs’ medical records and other information from Oak Ridge. This consisted of scanning tens of thousands of documents, many of which were over 30 years old and in fragile condition. This has been a costly, slow process. We are now working with our litigation support provider to assemble a coding standards manual to ensure that all of the documents are meaningfully coded and available for discovery. Once this is complete, the next step will be to proceed to examinations for discovery, which we will begin in 2011.

There is an individual trial set to commence on November 29, 2010, on behalf of a former patient of Oak Ridge. The plaintiff in the individual action is alleging the same abuse and human experimentation issues as the group action.
